Privacy Policy

This policy describes how GPS Tracker Shop LLC, operating spacehawkgps.com, collects, uses, and discloses your personal information when you visit the site, buy from us, or use a SpaceHawk GPS tracker.

Important: you control how your tracker is used

A GPS tracker collects location data about whatever it is attached to. You decide where yours goes, and you are responsible for making sure that use is legal.

Tracking a vehicle or asset you own is generally lawful. Tracking a person, or a vehicle you do not own or lease, may violate federal and state stalking, surveillance, wiretap, and privacy laws, and several states require the consent of the vehicle owner or driver. Penalties can be criminal.

We do not monitor, store, or control location data, and we are not able to police how a device is used after it leaves us. Determining whether your intended use is lawful is your responsibility. Full detail is in Sections 2 and 3.

Who we are and how to reach us

SpaceHawk GPS is a brand owned and operated by GPS Tracker Shop LLC, headquartered in California, United States.

Section 1

Information We Collect

We collect information about your device, your interaction with the site, information needed to process your orders, and, if you use a SpaceHawk tracker, data reported by that device. In this policy we refer to information about an identifiable individual as personal information.

Device and browsing information

Collected automatically when you access our site through cookies, log files, web beacons, tags, and pixels, and used to load the site correctly and to analyze how the site is used. This includes your browser version, IP address, time zone, cookie data, the pages and products you view, search terms, and how you interact with the site. Shared with our processor Shopify.

Order information

Collected from you when you buy, and used to fulfil your order, process payment, arrange shipping, send invoices and confirmations, communicate with you, screen orders for fraud, and, where you have opted in, send you marketing. This includes your name, billing address, shipping address, payment information, email address, and phone number. Shared with our processors Shopify, Authorize.net, and PayPal as relevant.

Customer support information

Collected from you when you contact us by phone, email, or chat, and used to provide support. This includes your name, contact details, order number, device serial number, and the contents of your message.

Section 2

GPS Device and Location Data

We do not hold your location data

Location data produced by a SpaceHawk tracker is collected, stored, monitored, and managed by LandAirSea Systems, Inc., the manufacturer of the device and the operator of the tracking platform. GPS Tracker Shop LLC does not host that data, does not store it, and does not monitor it. Your use of the tracking platform and the app is governed by LandAirSea Systems’ own privacy policy, which is available on landairsea.com.

A tracker reports over a cellular network to that platform so you can see it in the app. The data typically includes:

  • the location of the device, reported at the interval set by your plan
  • speed, direction of travel, and stop and start times
  • route and trip history for the period covered by your plan
  • battery level, signal strength, and device status
  • any geofences, alerts, or labels you create in the app

The account holder controls that data and who is given access to it. LandAirSea states that tracking data is stored on servers in the United States. Questions about how long location history is retained, how to export it, or how to have it deleted should be directed to LandAirSea Systems, since we are not able to answer them on their behalf.

What we hold is limited to the information described in Section 1: your order, your billing details, and any correspondence you have with our support team. We do not sell location data, we do not use it for advertising, and we could not do either, because we do not have it.

Section 3

Lawful Use of Tracking Devices Is Your Responsibility

Before you place a tracker on anything

You are solely responsible for ensuring that your use of a SpaceHawk tracker complies with all applicable local, state, federal, and international law.

  You must have the legal right to track the vehicle, asset, or property you attach a device to. In most cases that means you own it, lease it, or have the documented permission of the person who does.

  Tracking a person is not what these devices are for. Placing a tracker on a person, or on a vehicle belonging to someone else, may constitute stalking, unlawful surveillance, or a privacy offense, and several states require notice or consent.

  Employers have extra obligations. Tracking company vehicles is lawful in every state, but some states require written notice to employees before you begin.

  If you are not certain, do not track. Laws in this area change, and we cannot give you legal advice about your situation.

By purchasing and activating a device, you confirm that you have the legal right to track whatever you attach it to, and you agree to indemnify and hold harmless GPS Tracker Shop LLC from any claim arising out of your use of a device. Nothing in this policy is legal advice.

We do not monitor customer location data and we take no position on how a device is used after purchase. Responsibility for lawful use sits entirely with the account holder.

Section 4

How We Use Your Information

We use your personal information to provide our services to you, which includes offering products for sale, processing payments, shipping and fulfilling your order, operating the tracking platform, providing technical support, and keeping you up to date on new products, services, and offers where you have asked us to.

If you are a resident of the European Economic Area, we process your personal information under the following lawful bases: your consent; the performance of the contract between you and us; compliance with our legal obligations; to protect your vital interests; to perform a task carried out in the public interest; and for our legitimate interests, which do not override your fundamental rights and freedoms.

Sharing Your Information

We share personal information with service providers who help us run the business and fulfil our contract with you. For example:

  • Shopify, which powers our online store. Shopify’s privacy policy is at shopify.com/legal/privacy.
  • Payment processors, including Authorize.net and PayPal, to take payment securely.
  • Shipping carriers, to deliver your order.
  • LandAirSea Systems, Inc., which operates the tracking platform and the app, and which collects and stores the device data described in Section 2.
  • Analytics and advertising providers, as described in Section 7.

Section 6

Law Enforcement and Legal Requests

We may disclose the information we hold, meaning order and account records, where we are required to do so by law, or where we receive a valid subpoena, court order, search warrant, or other lawful request. We may also disclose it where we believe in good faith that disclosure is necessary to protect our rights, to protect your safety or the safety of others, or to investigate fraud.

We cannot produce location data, because we do not hold it. Any request for location history, whether from a customer, a third party, or a law enforcement agency, must be directed to LandAirSea Systems, Inc. as the operator of the tracking platform.

If your vehicle or asset is stolen, you as the account holder can share your live location with law enforcement directly from the app. We do not act on a request from anyone who is not the account holder unless legally compelled to do so.

Section 7

Behavioural Advertising

We use personal information to show you advertising and marketing that we believe may interest you. We use Google Analytics to understand how customers use the site, described at google.com/policies/privacy, and you can opt out at tools.google.com/dlpage/gaoptout.

We share information about your use of the site, your purchases, and your interaction with our ads with advertising partners, in some cases through cookies and similar technologies. We do not share GPS device location data with advertising partners.

Selling or Sharing Personal Information

We do not sell your personal information for money. We do not sell GPS device location data under any circumstances, and we hold none of it to sell.

Under the California Consumer Privacy Act as amended by the California Privacy Rights Act, sharing personal information with advertising partners for cross-context behavioural advertising may be treated as “sharing.” The categories that may be shared in this way are identifiers such as your email address, internet activity such as pages viewed, and commercial information such as products purchased.

To opt out of that sharing, use the advertising opt-outs in Section 7, or email help@spacehawkgps.com with the subject line “Do Not Sell or Share My Personal Information.” We honor the Global Privacy Control signal where your browser sends one.

We do not knowingly sell or share the personal information of anyone under the age of 16.

Section 9

Minors

This site is not intended for individuals under the age of 18, and we do not sell to minors. We do not intentionally collect personal information from children, and we do not knowingly collect personal information from anyone under the age of 13.

If you are a parent or guardian and believe your child has provided us with personal information, contact us at help@spacehawkgps.com and we will delete it.

Section 10

Retention

When you place an order through the site, we retain your personal information for our records unless and until you ask us to erase it, subject to any records we are required to keep for tax, accounting, or legal reasons.

Location data reported by a device is retained as described in Section 2.

Section 11

Your Rights

California residents

If you are a resident of California, you have the right to know what personal information we hold about you, to receive a copy of it, to ask us to correct or delete it, and to opt out of the sale or sharing of your personal information. You may also designate an authorized agent to make a request on your behalf. We will not discriminate against you for exercising any of these rights. To make a request, email help@spacehawkgps.com.

EEA and UK residents

If you are a resident of the European Economic Area or the United Kingdom, you have the right to access the personal information we hold about you, to port it to a new service, and to ask that it be corrected, updated, or erased. You also have the right to object to processing based solely on automated decision-making where that decision has a legal or similarly significant effect on you.

We do not engage in fully automated decision-making that has a legal or similarly significant effect using customer data. Our processor Shopify uses limited automated decision-making to prevent fraud, including temporary blocking of IP addresses and payment cards associated with repeated failed transactions, which does not have a legal or similarly significant effect on you.

Your personal information may be transferred outside Europe for storage and processing, including to Canada and the United States. Shopify’s GDPR documentation is available at help.shopify.com.

Section 12

Cookies

A cookie is a small amount of information downloaded to your computer or device when you visit our site. We use functional, performance, advertising, and social media cookies. Functional cookies keep your cart, your login, and your region settings working. Performance cookies tell us how the site is used. Advertising cookies support the marketing described in Section 7.

Shopify maintains a current list of the cookies used on merchant storefronts at shopify.com/legal/cookies. Most of the cookies we use are persistent and expire between thirty minutes and two years after they are placed. Session cookies expire when you close your browser.

You can accept, block, or delete cookies through your browser settings, usually found under Tools or Preferences. Blocking cookies may break parts of the site. Blocking cookies alone does not stop information being shared with advertising partners, so use the opt-outs in Section 7 as well.

Section 13

Do Not Track

There is no consistent industry standard for responding to Do Not Track signals, so we do not alter our data collection when we receive one from your browser. We do honor the Global Privacy Control signal for opt-out of sale or sharing where your browser sends it.

Section 14

Security

We take reasonable technical and organizational measures to protect the personal information we hold, including encryption of payment card data in transit, restricted staff access to customer records, and reliance on established processors such as Shopify for storage and payment handling. Security of the tracking platform and of the location data it holds is the responsibility of LandAirSea Systems, Inc.

No method of transmission or storage is completely secure, and we cannot guarantee absolute security. Protect your own account by using a strong, unique password for the tracking app and by telling us promptly if you believe your account has been accessed without your permission.

Section 15

Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes to our practices or for other operational, legal, or regulatory reasons. The date at the top of this page shows when it was last revised.

If you would like to make a complaint, contact us at help@spacehawkgps.com. If you are not satisfied with our response, you may lodge a complaint with your local data protection authority. California residents may contact the California Privacy Protection Agency, and residents of the EEA or UK may contact their national supervisory authority.
